Further thereto, the Story & Designs platform does not accept any liability for any loss and/or damage that may arise due to said refusal and/or cancellation and/or revocation.

In the event of possible fraudulent activities and/or unauthorised and/or illegal transactions are suspected, the Story & Designs platform reserve the right to refuse and/or revoke and/or cancel said purchase.

Availability, Errors, and Inaccuracies

The Story & Designs platform is constantly striving to offer clients latest and updated services in respect of their offerings. Accordingly, the services offered by the Story & Designs platform may be mispriced, described inaccurately, or unavailable due to delays in respect of updating said information. You specifically agree that such offer of any product or service listed on the Story & Designs platform does not constitute a legal offer capable of attracting legal consequences.

 As aforementioned, the Story & Designs platform is unable to guarantee the accuracy and/or the completeness of the information listed on the platform, which includes but is not limited to the price of products, description of products, specifications, and the availability of same. By using the Story & Designs platform, you agree not to upload, post, e-mail or otherwise send and/or transmit any material that contains viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Story & Designs platform.

You also agree not to interfere with the servers or networks connected to the Story & Designs platform and/or to violate any of the procedures, policies, or regulations of networks connected to the Story & Designs platform, the terms of which are incorporated herein. Story & Designs does not promote, recommend or condone use of the Story & Designs platform during certain activities, such as driving, where there is a significant risk of accident. You agree not to use the Story & Designs platform during such activities.

The Story & Designs platform reserves the right to refuse services to any individual and/or legal entity, website, or blog that contain offensive, obscene, hateful, and/or malicious content.

Third Party Offers

The Story & Designs platform may contain links to third-party websites or programs that are not controlled by or affiliated to Story & Designs platform. Story & Designs platform is not responsible for the content, offers or privacy policies of such sites and programs, including, without limitation, your redemption of such offers or a merchant's refusal to honour any offer. Your dealings with third-party sites are solely between you and the applicable third party.

Client Modifications

The Story & Designs platform may provide users with a Wix and/or Kajabi website, where same was purchased. However, the platform reserves the right to provide users with a different website, which would be dependent on the package purchased, availability and other factors that may be reasonable in the circumstances.  The Client will and may independently edit and/or alter and/or update his or her web page/s upon the completion of said site, subject to same otherwise being reduced in writing and agreed to by the Client and Story & Designs.

 

In instances where any other person, save for Story & Designs, attempts to update said website and/or damages and/or impairs same in said process in respect of the websites functionality and display, Story & Designs shall repair said damage and/or impairment at a rate of £50/hr (excluding VAT) which may be beyond the time indicated in the customer’s purchase. In respect of same, a 1 hour minimum would be applicable.

 

Subscription Fees 

By purchasing a monthly subscription (either the Starter Plan, Premium Plan or, Elite Plan), you agree to an initial and recurring monthly subscription fee at the then current month subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your monthly subscription at any time, subject to our cancellation policy and/or refund policy.

​

You will be billed in advance on a recurring and periodic monthly basis. At the end of any billing cycle, your subscription shall continue automatically under the exact same terms and conditions as enclosed herein.  A valid method will be required to process said payment, should said payment be unsuccessful for any reason whatsoever, the Story & Designs platform shall issue you with an invoice indicating that you are required to attend to said payment manually whilst simultaneously providing you with a deadline for same. Should said payment not occur, the Story & Designs platform reserves the right to cancel your subscription.

The Story & Designs platform may at its sole description and at any time modify and/or alter the aforementioned subscription fees. Should a subscription fee change occur, same will be effective as of the end of the then-current billing cycle. In respect of same, reasonable prior notice shall be provided by the Story & Designs platform to provide Clients with the ability to cancel said subscription, should same be required.

​

A Clients continued use of the service shall be deemed to have accepted said modification of the subscription fee and shall be incorporated into this agreement. 

​

When you use the Story & Designs platform, you may be subject to charges imposed by your wireless or other applicable carrier. Payment of such charges is solely your responsibility. The Story & Designs platform may not be accessible in some foreign countries, this will depend on the Story & Designs platform being supported by the foreign network. You should check with the local carrier whether you will be required to pay additional charges for such access. The ability to access the Story & Designs platform may be restricted or impaired when on a roaming network abroad.

Accounts

You can create an account on the Story & Designs platform. In respect of said creation, you agree not to use any false, inaccurate, or misleading information when signing up for said account. If you create an account on behalf of an entity, such as your business or employer, you represent that you have the legal authority to bind that entity to these Terms and Conditions. You cannot transfer your account credentials to another user or entity. To protect your account, keep your account details and password confidential. You are responsible for all activity that occurs under your account.

Refunds

The Story & Designs platform shall consider certain refund requests in respect of subscriptions on a case-by-case basis at its sole discretion. You are requested to familiarize yourself with our cancelation policy and/or refund policy that can be located at the bottom of the Story & Designs platform.

​

In the event that you wish to cancel your subscription, you are required to contact our offices, the details of which can be found on the Story & Designs platform. We will thereafter send you the required cancelation form which you are required to complete and return to our offices.

​

Irrespective of the aforementioned cancellation, all provisions listed herein by their very nature shall survive said termination.

​

Website Hosting Service

You are required to include “Website by Story & Designs” on the footer of all client websites, this must remain intact throughout the entire duration of your subscription. The website designs and templates belong to the Story & Designs platform and may not be used anywhere else unless specifically authorized in writing by a duly appointed representative of Story & Designs. The Story & Designs platform provides a managed service, full admin access of the WordPress website is not provided as the platform shall be responsible solely for the maintenance and updates. 

 

Use of Information Submitted

You agree that Story & Designs is free to use any comments, information or ideas contained in any communication you may send to Story & Designs without compensation, acknowledgment, or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Story & Designs platform or other products or services.

No Warranty & Liability Limit

Story & Designs provides the Story & Designs platform "as is" and without any warranty or condition, whether express, implied, or statutory. Story & Designs specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement. Story & Designs assumes no liability or responsibility for any errors or omissions in the Story & Designs platform; any failures, delays, or interruptions in the Story & Designs platform; any losses or damages arising from the use of the use of the Story & Designs platform, including, without limitation, any damage to your household/office/building equipment, electronic devices, etc; or any conduct by users of the Story & Designs platform. We reserve the right to deliver, alter, suspend or restrict the Story & Designs platform in our sole and absolute discretion.

In no event shall Story & Designs, its shareholders, directors, officers, employees, or agents be liable (jointly or severally) to you for loss of use or any special, incidental, indirect, or consequential damages arising out of or in connection with the Story & Designs platform or these terms of service, on any theory of liability, and whether or not advised of the possibility of damage. In addition, we shall not be responsible for any business losses, including but not limited to loss of business, profits, revenue, or goodwill. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

Indemnity

You agree to indemnify and hold Story & Designs and its related companies, and each of their respective shareholders, directors, officers, employees, agents, and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of your use of the Story & Designs platform or your violation of any law or the rights of any third party.

 

Disputes

If you are not happy with how we have handled any matter related to your purchase you are requested to direct said complaint/s and/or disputes to our offices, the details of which can be located on our contact page of the Story & Designs platform. Should you not be satisfied with the manner in which we handled your complaint you are may contact the relevant tribunal.

Governing Law 

You agree that these Terms and Conditions or any claim, dispute or controversy (whether in contract, tort or otherwise, whether pre-existing, present or future, and including statutory, common law and equitable claims) between you and Story & Designs arising from or relating to these Terms and Conditions, their interpretation or breach, termination or validity, the relationships which result from these Terms and Conditions, the Story & Designs platform, Story & Design’s advertising or any related transaction shall be governed by and construed in accordance with the laws of England and Wales and subject to the non-exclusive jurisdiction of the courts within said jurisdictions.

Acceptance

By submitting your payment, you hereby accept and agree to the terms listed herein and accordingly confirm same to be valid and binding on yourself.

General

If any provision of these is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or any other provision. These Terms and Conditions set forth the entire understanding and agreement between you and the Story & Designs platform with respect to the subject matter hereof. This agreement constitutes the entire agreement between the parties.
